You must read and agree to these Terms and Conditions before ordering from Insignia Garden. By placing an order or using insigniagarden.com (referred to hereafter as "the Website"), You ("You" or "Customer") agree to be bound by these terms with Insignia Summit LLC, the owner and administrator of this Website ("Our", "Us", or "We"). If You do not agree, please do not use the Website or place an order.

Use of the Website

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of, this Website by any third party. You may not reproduce, duplicate, copy, sell or resell any part of the Website or its photography without our written permission.

All prices are in US dollars. Prices, finishes and availability may change without notice. Seeds are supplied subject to seasonal availability; where a piece or variety is temporarily unavailable we will contact You before charging or shipping any part of Your order.

Orders & Payment

All orders are subject to acceptance and availability. Payment is taken at the time of purchase and the charge on Your credit card statement will appear as insigniagarden.com. We reserve the right to refuse or cancel any order, including where we suspect fraud or an error in pricing or stock.

Shipping & Delivery

Orders are packed and dispatched within 1–2 business days. Standard shipping is free within the United States and arrives in 3–5 business days, with tracking sent by email. We do not ship or deliver on Saturdays, Sundays, or any holidays. Insignia Summit LLC does not guarantee specific arrival dates or times and is not responsible for delays caused by the carrier once a parcel is in transit. Live plants are not sold through this Website; all seed is shipped dormant and dry.

Returns & Exchanges

You may return any piece within 30 days of delivery, unused and in its original packaging, for a refund to the original payment method. Sealed seed packets must be unopened, and tools must be clean and unused. Return shipping is free where we have supplied the label. Refunds are issued within 5 business days of the returned parcel being received and inspected. Because seed is a living product, we cannot refund packets that have been opened, and germination depends on conditions outside our control.

Materials, Growing & Care

Our planters are hand-thrown terracotta, hand-glazed stoneware, or woven seagrass. Our tools are copper and forged brass with leather-wrapped handles. Terracotta is porous and not frost-proof; bring it indoors over winter. Copper and brass are expected to darken with use. Sowing windows, depths and spacing printed on each seed packet are guidance only, and results vary with light, water, soil and climate. Damage caused by weather, water, chemicals or mishandling is not covered by our returns policy.

Intellectual Property

All content on this Website — including product photography, copy, logos and designs — is the property of Insignia Summit LLC and may not be used, copied or reproduced without written consent.

Warranties & Limitation of Liability

To the maximum extent permitted by applicable law, Insignia Summit LLC disclaims all warranties, express or implied, including, without limitation, implied warranties of merchantability and fitness for a particular purpose. In no event shall Insignia Summit LLC or its officers, directors, employees, or agents be liable for any indirect, incidental, special, or consequential damages arising from this Agreement, the products, or the Customer's use of the Website. You agree that Insignia Summit LLC's total liability shall not exceed the amount You paid in the one month period immediately preceding the incident.

Governing Law

These Terms are governed by the laws of the State of Texas, United States, and any dispute shall be resolved in the courts of that state. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
